I. Introduction

The Âé¶¹Ãâ·Ñ°æÏÂÔØ (Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder) is dedicated to creating a safe, inclusive, and supportive environment for all members of its community, including students, staff, faculty, Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder affiliates, and visitors. In pursuit of this goal, Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder will take reasonable and proactive measures to foster an environment free from violence, threats of violence, harassment, intimidation, and other disruptive behavior that occurs on university-owned, leased, or controlled property (Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder property).Ìý

Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder prohibits any form of violence, threat, harassment, intimidation or disruptive behavior. Not all threats, nor those who threaten, are equal in their potential for harm, but all threats that are brought to the attention of Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder will be taken seriously, evaluated, and documented.ÌýÌý

Violence or threats of violence by persons from outside the Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder community will be managed appropriately by the Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder Police Department (CUPD) and the Department of Threat Assessment (DTA).Ìý

This policy does not apply to behaviors covered by Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder’s policies on prohibited protected class discrimination.Ìý

II. Definitions

Authorized personnel: The chancellor, the vice chancellor for public safety or any other Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder official designated by the chancellor or vice chancellor for public safety with the authority to issue campus exclusions. Ìý

Exclusion: An order, issued by authorized personnel, which excludes a person from any Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder property, either permanently or for a specified term. Exclusions may be ordered when there is imminent risk to individual health and safety or Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder property or operations, a violation of Âé¶¹Ãâ·Ñ°æÏÂÔØpolicies or federal, state, municipal or Regent laws or a determination by any authorized personnel that a person may be detrimental to the well-being of the Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder community.ÌýÌý

Physical Harassment: Behaviors where a person, with intent to harass or annoy another, strikes, shoves, kicks, spits on, or otherwise touches or subjects an individual to contact.Ìý

Imminent: Close in time, about to occur.Ìý

Intimidation: A serious act or course of conduct directed at a specific person that causes fear or apprehension in such person and serves no legitimate purpose.Ìý

Threat: An expression of intent to do harm or act out violently against someone or something. A threat can be spoken, written, or symbolic.Ìý

Violence: Behavior involving physical force that hurts, damages or otherwise harms someone or something.Ìý

III. Policy Statement

Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder prohibits violence, threats, physical harassment, intimidation, or other disruptive behavior prohibited by applicable law on Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder property or in its programs. Persons who violate the Campus and Workplace Violence Policy may be subject to sanctions including, but not limited to, removal from Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder property, exclusion from Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder property, criminal prosecution, corrective or disciplinary action, suspension, or expulsion. Ìý

Per Article 14.B.4 of the Laws of the Board of Regents, while on university property, persons who are not employees of the university shall adhere to the standard of conduct applicable to university employees and shall abide by all applicable university regulations. With this expectation, all persons at Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder are encouraged to report any threats they witness, receive, or learn about from third parties. Additionally, any threatening or violent behavior observed in relation to university employment or activities or on Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder property should be reported. Reporting such behavior helps ensure that Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder can address and mitigate potential risks and maintain a safe community.Ìý

To effectively implement this policy, Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder urges persons who experience or witness violent behavior on any Âé¶¹Ãâ·Ñ°æÏÂÔØBoulder property or in its programs to report it immediately in alignment with the Campus and Workplace Violence Reporting Procedure.Ìý

In addition to reporting concerns according to the Campus and Workplace Violence Reporting Procedure, mandatory reporting to the Office of Institutional Equity and Compliance (OIEC) and in accordance with the Clery Act is still required. Mandatory reporters—any employee who has the authority to hire, promote, discipline, evaluate, grade, formally advise, or direct faculty, staff, or students— must report to OIEC. Ensure that you are following established reporting lines to maintain compliance.Ìý
